Besides rape is oppression which is worse than murder. (2:190-193)

Thank you Sardar for your time
that trade  covers MmA, but not rape. Anyway u said rape is oppression which oppression is worse than murder. Are u saying that punishment of murder can be given to rape case since murder is punished by taking away the life of the murderer if not pardoned.

Maybe I understood u wrong

Honestly i am not an expert of law so sadly i can not give you a very detailed explanation. Rape is about dominating the victim and the victim has every right to punish his or her rapist either execute or imprison the perpetrator.

In the Quran there are verses about equivalent punishment or retaliation, patience & righteousness:

16:126 وان عاقبتم فعاقبوا بمثل ما عوقبتم به ولئن صبرتم لهو خير للصبرين
Wa-in AAaqabtum faAAaqiboobimithli ma AAooqibtum bihi wala-in sabartum lahuwakhayrun lilssabireena
And if you punish, then punish with equivalence to that which you were punished. And if you are patient then it is better for the patient ones.

Thalika waman AAaqaba bimithlima AAooqiba bihi thumma bughiya AAalayhi layansurannahuAllahu inna Allaha laAAafuwwun ghafoorun
It is decreed that whoever retaliates with equal measure as was retaliated against him, then he was persecuted for this, God will give him victory. God is Pardoning, Forgiving.

Ya ayyuha allatheena amanookutiba AAalaykumu alqisasu fee alqatla alhurrubialhurri waalAAabdu bialAAabdi waalonthabialontha faman AAufiya lahu min akheehi shay-on faittibaAAunbialmaAAroofi waadaon ilayhi bi-ihsaninthalika takhfeefun min rabbikum warahmatun famaniiAAtada baAAda thalika falahu AAathabunaleemun
O you who believe, equivalence has been decreed for you in the case of those who are slain; the free for the free, and the slave for the slave, and the female for the female. Whoever is forgiven anything by his brother, then it is to be followed with kindness and goodness towards him; that is an alleviation from your Lord, and a mercy. Whoever transgresses after that, he will have a painful retribution.

Walakum fee alqisasi hayatunya olee al-albabi laAAallakum tattaqoona
And through equivalence you will be protecting life, O you who possess intelligence, that you may be righteous.

Waqatiloo fee sabeeli Allahiallatheena yuqatiloonakum wala taAAtadooinna Allaha la yuhibbu almuAAtadeena
And fight in the cause of God against those who fight you, but do not aggress, God does not love the aggressors.

Waoqtuloohum haythuthaqiftumoohum waakhrijoohum min haythu akhrajookum waalfitnatuashaddu mina alqatli wala tuqatiloohum AAindaalmasjidi alharami hatta yuqatilookumfeehi fa-in qatalookum faoqtuloohum kathalikajazao alkafireena
And kill them wherever you encounter them, and expel them from where they expelled you, and know that persecution is worse than being killed. And do not fight them at the Restricted Temple unless they fight you in it; if they fight you then kill them, thus is the recompense of the rejecters.

Fa-ini intahaw fa-inna Allahaghafoorun raheemun
And if they cease, then God is Forgiving, Merciful.

Waqatiloohum hatta latakoona fitnatun wayakoona alddeenu lillahi fa-iniintahaw fala AAudwana illa AAala alththalimeena
And fight them so there is no more persecution, and so that the system is for God. If they cease, then there will be no aggression except against the wicked.

Alshshahru alharamu bialshshahrialharami waalhurumatu qisasunfamani iAAtada AAalaykum faiAAtadoo AAalayhibimithli ma iAAtada AAalaykum waittaqoo AllahawaiAAlamoo anna Allaha maAAa almuttaqeena
The restricted month may be met within the restricted month, and what is unlawful may be met with retaliation. Whoever attacks you, then you shall attack him the same as he attacked you; and be aware of God, and know that God is with the righteous.

I hope my answer helped you.
