yes i would like the thought of only carrying orders which you think is ok/lawful, but how far would that go to?
There is a difference between thinking an order is "ok" and an order being lawful or unlawful. I'd try to change a bad order that unduly endangers mission success or welfare of servicemembers, carry out lawful orders and refuse to carry out unlawful orders (and report them). An example of a bad (but not unlawful) order would be to charge a fortified position directly when better means/methods are available.
It is usually pretty obvious if an order is illegal. Murder is illegal. Theft is illegal. Rape is illegal. Robbery is illegal. Illegal orders are unlawful to carry out. Orders that are lawful must be carried out; it is the only way that an organization can properly function. Leaders are responsible for the actions of subordinates acting under their leadership/command/orders.
If given an unlawful order, the steps to take are as follows:
Repeat the unlawful order.
Ask for clarification of the unlawful order.
Refuse to carry out the unlawful order.
Report the unlawful order.
One safeguard against illegal orders (or toxic leaders in general) is to record conversations. This can be done with most cell phones or with a dedicated recording device. Although recordings may not be admissable in justice proceedings, if a person denies under oath having said what was recorded (said recording not being *yet* presented), the recording can be admitted into evidence to demonstrate that the person has committed the crime of perjury.
Servicemembers sometimes have to carry out orders, (perhaps even stupid
orders), that put their lives in danger, but that doesn't mean that the orders are necessarily illegal. Servicemembers are OBLIGATED to not carry out unlawful orders.
Good people tend to undertake good/positive/constructive actions. The presence of good people in an organization stymies the actions "bad" or amoral people might otherwise take. For example, a thief is loath to steal when coupled with a competent police officer.2:216 Warfare has been decreed for you while you hate it; and perhaps you may hate something while it is good for you, and perhaps you may love something while it is bad for you; and GOD knows while you do not know.
